Competition Lawyer (M/F)

THE ROLE

 

Within the Compliance team of the CMA CGM Group, you advise all entities of the CMA CGM Group (headquarter functions and subsidiaries) on any matters in relation to applicable competition laws (mostly antitrust infringements and merger control) as well as on any pricing regulatory matters. Under the supervision of the Group Chief Compliance Officer, you are reporting to the Competition Compliance Manager.

 

 

RESPONSIBILITIES

 

You are part of a team of dedicated competition/regulatory lawyers. You provide legal support on competition law issues to business units across the world (shipping lines, terminal operators, ancillary logistics services, procurement department, air cargo division, etc.) and to lawyers of the Group Legal Department. Thanks to your expertise, you assess the competition risks of the envisaged operations and of on-going commercial practices, in order to pinpoint pragmatic solutions and ways forward that are compliant with applicable competition laws and pricing regulations.

 

Among the range of daily tasks that you handle:

  • You verify the lawfulness of operational partnerships depending on domestic regulations, in particular cooperative agreements among ocean carriers (alliances, consortia, any other horizontal cooperation framework);
  • You bring along merger control technical support for Group transactions, and you liaise both from a practical and a substantive perspective the (multi)filing of those mergers before the relevant competition authorities;
  • You advise on and coordinate actions in pre-litigation and litigation procedures, as well as the answers to any consultation procedures of competition authorities worldwide;
  • You take part into the set up and drafting of internal procedures to ensure compliance with competition rules and you train business staff in a user-friendly manner;
  • You perform contract reviews to ensure competition compliance;
  • You are involved in assisting in a wide range of regulatory matters (filing of partnership agreements, regulation regarding pricing and surcharges, environmental regulations, sector regulations, etc.);
  • You perform general competition law and sectoral regulation monitoring.
  • You coordinate the required actions from all in-house stakeholders as well as from external contact points (lawyers, competition authorities officials, government officials, contractual partners, etc.).

 

 

SKILLS AND QUALIFICATIONS

 

  • You have a postgraduate degree (Master 2) in Law, along with a professional experience of 5-8 years dedicated to competition law advice or enforcement. A previous experience as a qualified lawyer or a legal counsel in a Competition Authority is an asset. A previous experience in the fields of transportation or of supply chain management would also be appreciated;
  • You are fluent in English, both oral and written;
  • You display enhanced organizational and communication skills, in particular to streamline message in relation to competition law and pricing issues;
  • You are able to handle complex tasks within imperative deadlines, while applying a pragmatic solution-oriented mindset;
  • Your rigor and reactivity, as well as your analytical and synthesis capacities will enable you to safeguard the the Group’s commercial and legal best interests.
