As part of its growth and development, CMA CGM Holland is looking for a Legal & Claims Counsel to join its Legal team. 


ABOUT THE ROLE
The Legal & Claims Counsel assumes a pivotal role in deftly orchestrating a diverse spectrum of legal and claims activities. With precision and expertise, they navigate these responsibilities, ensuring seamless alignment with the Company's overarching objectives and stringent compliance standards. In this multifaceted position, the Counsel expertly combines legal acumen with claims handling, providing a comprehensive approach.


The key responsibilities of the Legal & Claims Counsel are as such :

  1. Handling cargo claims and monitoring hull and personal injury claims: 
    • ​​Maintaining contacts with internal and external stakeholders, including other CMA CGM offices, customers, insurance companies, (P&I Club) surveyors,  principals, agents, stevedores, customs, terminals, captains’ room, lawyers etc.; 
    • Full handling of (cargo) claims and doing all necessary work involved; 
    • Advising colleagues/customers/principal concerning claims.
  2. Legal advice: 
    • All B/L terms & conditions related questions and other maritime law related questions;
    • All general local law related questions for CMA CGM Holland BV and CMA CGM worldwide;  
    • Review local contracts.
  3. General: 
    • Incident and risk management: coordinating incidents in the sea and on land; 
    • Coordinating full idle cases: finding a solution for longstanding containers, either out of court or via proceedings.

 

SKILLS AND COMPETENCIES

  • Legal and Shipping background: Education on WO (university) level is a must with at least a Bachelor’s degree in law. Preferably holds a Master's degree in Maritime or Commercial law;
  • 5 years of relevant working experience with at least 3 years of experience in claims handling in the maritime sector (either inhouse or as a lawyer);
  • Possesses strong operational and commercial acumen;
  • Demonstrates excellent communication and interpersonal skills;
  • Ability to work independently and collaboratively in a team environment;
  • Fluent in both spoken and written English (Dutch is a plus);
  • Exhibits flexibility and the ability to perform well under pressure;
  • Possesses a valid working permit and is based/located in the Netherlands.
